Terms of Service

Welcome to Pain Tracker App — a free headache tracking tool available as a Telegram bot (@MigraineAppBot) and via our web interface (e.g. pain-tracker.app and web.pain-tracker.app).

These Terms of Service ("Terms") govern your use of Pain Tracker App. They explain your rights and responsibilities, what you can expect from us, and important limitations of the service. By using Pain Tracker App, you agree to be bound by these Terms. If you do not agree, you must not use the service.

The service is operated by:

1. What Pain Tracker App Does (and Doesn't Do)

Pain Tracker App helps you keep track of your migraine symptoms and related patterns. You can use it privately or to share your reports with your doctor — that's one of the main goals of the app.

Pain Tracker App does not provide any medical advice or diagnosis. It's not a medical tool, does not offer treatment recommendations, and can't tell you what to do about your symptoms. Please don't use it to make medical decisions. Always consult a qualified doctor if you have questions about your health.

2. Who Can Use the Service

Pain Tracker App is intended for users aged 16 and older. If you're younger than that, you need the consent of a parent or legal guardian.

You can register either by email (via the web app) or by Telegram (where we receive your username and user ID). Your use of the service must comply with all applicable laws — including sanctions, export controls, and health data regulations in your country.

3. Using Pain Tracker App

You're welcome to use Pain Tracker App to log and analyze your own health data. You can export your logs, delete them, or reset your data at any time using in-app features. Sharing your reports with your healthcare provider is allowed and encouraged.

Please don't misuse the service. That means:

  • Don't upload someone else's data without their permission.
  • Don't use the service in a way that's illegal, harmful, or abusive.
  • Don't try to break, reverse engineer, or overload the service.

We reserve the right to suspend or block access if the service is misused or if required by law.

4. Service Availability and Changes

Pain Tracker App is offered as a free and non-commercial service. We do our best to keep it available and stable, but we don't guarantee uptime or uninterrupted service. There may be bugs, outages, or updates — especially since the app is maintained by a single developer in spare time.

We may update or change features over time. We may also decide to stop offering the service completely — for example, if it becomes too expensive or technically difficult to maintain.

If we ever need to shut down Pain Tracker App entirely, we'll do our best to notify active users at least 30 days in advance, and we'll offer a way to export your data before access is removed.

5. Account and Data Deletion

You can delete your account or reset your data at any time using the /reset command (in the bot) or through the app settings. When you do, we delete your logs, reports, and other stored data — except for the minimal technical information needed to prevent duplicate signups (like your user ID and initial registration date).

We may also delete inactive accounts after a long period (e.g., 6+ months of no usage), or terminate accounts that violate these Terms. If that happens, we will notify you in advance when possible.

6. Your Privacy

We care about your privacy. We don't sell your data, and we only use your information to operate and improve Pain Tracker App. Full details about how we handle data — including encryption, data processors, and your rights — are explained in our separate Privacy Policy, which is always available inside the app.

By using the service, you confirm that you have read and agree to our Privacy Policy, which forms part of your agreement with us.

7. No Medical Liability

Pain Tracker App is designed as a personal health tracker — not a medical device, not a diagnostic tool, and not a replacement for a doctor.

We do not make medical claims. The reports and statistics we generate are based solely on what you enter, and they are meant for informational use only.

We are not liable for any harm or damages that result from decisions you make based on the app's data, or for delays in seeking care. Always consult your doctor for medical concerns.

8. Disclaimer of Warranty

To the maximum extent permitted by applicable law, Pain Tracker App is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties including, without limitation, any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The app will work perfectly or without error at all times
  • Reports will always be accurate or complete
  • Your use of the service will be uninterrupted or secure

You use Pain Tracker App at your own risk.

9. Limitation of Liability

To the extent permitted by applicable law, we (Vitalii Rizo and any persons involved in operating the service) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, loss of profits, missed reminders, incorrect reports, health outcomes, delayed treatment, temporary or permanent unavailability of the service, or third-party actions (including sanctions or blocked access). Our total aggregate liability to you for any claims arising out of or relating to these Terms or your use of Pain Tracker App shall not exceed €100 (one hundred euros) or the amount you have paid us in the twelve (12) months preceding the claim (if any), whichever is less.

Nothing in these Terms excludes or limits our liability where such exclusion or limitation is not permitted by applicable law (for example, in some jurisdictions, liability for death or personal injury caused by negligence, or for fraud, cannot be excluded). If you qualify as a consumer under mandatory consumer protection laws (e.g. in the EU), your statutory rights remain unaffected by the above limitation to the extent that they cannot be lawfully limited.

10. International Use and Sanctions

Pain Tracker App is operated from Germany and hosted in the EU. We do not restrict access based on nationality, but you are responsible for complying with your country's laws, including sanctions and import restrictions.

If your country or payment system becomes subject to trade restrictions that affect Pain Tracker App's availability, we are not liable for loss of access or consequences beyond our control.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, without regard to its conflict-of-law rules. Any disputes arising out of or in connection with these Terms or the service shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany, unless mandatory consumer protection laws in your country of residence require otherwise or give you the right to bring proceedings in your place of residence. If you are a consumer in the European Union, you may also be entitled to use the European Commission's online dispute resolution platform.

12. Changes to These Terms

We may update these Terms from time to time to reflect legal, technical, or product changes. We will post the updated Terms and update the "last modified" date. If we make a significant change, we will use reasonable means to notify you (for example, through the app or by email if we have your address). Your continued use of Pain Tracker App after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the service.
